DISTANCE SALES AGREEMENT

1. PARTIES

This Distance Sales Agreement (“Agreement”) is entered into electronically between the accommodation provider identified below (“Provider”) and the person making the reservation (“Guest” or “Consumer”) under the terms and conditions set forth herein.

Where legally applicable, the Provider’s registered company name, tax office, tax number and/or MERSİS number shall be stated on the reservation confirmation, invoice or other official commercial document issued to the Guest.

GUEST / CONSUMER

The Guest’s identity, contact details, reservation dates, selected room type, number of guests, total price and payment details are the information entered and confirmed by the Guest during the reservation process.

The Guest declares that the information provided during the reservation is accurate and complete.


2. SUBJECT OF THE AGREEMENT

The subject of this Agreement is the provision of accommodation and, where applicable, additional services selected by the Guest through Cappadocia Divin House’s website, reservation system, telephone, email or other distance communication method.

This Agreement regulates the rights and obligations of the parties in accordance with the applicable provisions of Turkish law, including Law No. 6502 on the Protection of Consumers and the Distance Contracts Regulation.


3. RESERVATION DETAILS

The essential characteristics of the accommodation service, including:

  • room type,

  • check-in date,

  • check-out date,

  • number of nights,

  • number of guests,

  • included services,

  • applicable taxes,

  • total reservation price,

  • payment conditions, and

  • cancellation conditions

are displayed to the Guest before the reservation is completed and are included in the reservation confirmation.

The reservation confirmation sent electronically to the Guest forms an integral part of this Agreement.


4. ESTABLISHMENT OF THE AGREEMENT

The Guest acknowledges that, before completing the reservation, they have been informed of the essential characteristics of the accommodation service, total price, payment method, cancellation conditions and other relevant reservation terms.

The Agreement is deemed concluded when the Guest completes the reservation process and the reservation is confirmed by the Provider.

A reservation is not considered guaranteed unless confirmation has been issued by the Provider or the authorized reservation system.


5. PRICE AND PAYMENT

The total price payable for the reservation is the amount displayed and accepted by the Guest at the time of booking.

The price may include accommodation, taxes and any additional services expressly stated in the reservation confirmation.

Services not expressly included in the reservation price may be charged separately.

Payment may be collected:

  • in full at the time of reservation;

  • partially as a deposit or prepayment; or

  • at the property,

depending on the rate and reservation conditions selected by the Guest.

The payment and cancellation rules applicable to the selected rate shall be displayed before the reservation is confirmed.


6. CHECK-IN AND CHECK-OUT

Unless otherwise stated in the reservation confirmation:

Check-in: From the hotel's published check-in time on the arrival date.
Check-out: By the hotel's published check-out time on the departure date.

Early check-in and late check-out are subject to availability and may incur an additional charge.

The Guest may be required to present a valid passport, national identity card or other legally accepted identification document at check-in.


7. CANCELLATION, MODIFICATION AND NO-SHOW

Cancellation and modification conditions vary depending on the rate plan selected during the reservation.

The Guest shall review and accept the applicable cancellation conditions before completing the reservation.

For flexible reservations, cancellation or modification may be permitted within the period specified in the reservation confirmation.

For non-refundable, promotional or specially discounted rates, advance payments may be non-refundable where this condition has been clearly disclosed before purchase.

If the Guest fails to arrive without cancelling the reservation within the applicable cancellation period (“no-show”), the Provider may charge the amount specified under the reservation conditions.

Requests for cancellation or modification should be submitted using the contact information stated in this Agreement or through the booking platform through which the reservation was made.

Where a reservation was made through a third-party booking platform or travel agency, that platform or agency's applicable cancellation and modification procedures may also apply.


8. RIGHT OF WITHDRAWAL

Under Article 15 of the Distance Contracts Regulation, the statutory right of withdrawal applicable to many distance contracts does not apply to accommodation services that are to be provided on a specific date or during a specific period.

Accordingly, hotel reservations made for specified accommodation dates are subject to the cancellation and refund conditions accepted by the Guest at the time of booking rather than the general fourteen-day right of withdrawal.

This provision does not restrict any mandatory consumer rights that cannot legally be waived.


9. REFUNDS

Where the Guest is entitled to a refund under the applicable reservation conditions, the refund shall generally be made using the same payment method used for the original transaction, unless otherwise agreed or technically required.

Banking institutions, payment processors and card issuers may require additional processing time after the Provider initiates the refund.

Any deductions expressly permitted under the accepted cancellation policy shall be disclosed to the Guest.


10. ACCOMMODATION AND HOTEL RULES

The Guest agrees to comply with the reasonable rules of Cappadocia Divin House during the stay.

Guests are responsible for any damage caused intentionally or negligently by themselves or persons included in their reservation.

Smoking, pets, additional guests, children, extra beds and similar matters are subject to the hotel's current policies as communicated on the website or reservation confirmation.

Illegal activity, behavior that threatens the safety or comfort of other guests or staff, or serious violation of hotel rules may result in termination of the accommodation service subject to applicable law.


11. FORCE MAJEURE

Neither party shall be liable for failure or delay in performing obligations caused by circumstances beyond their reasonable control, including but not limited to:

  • natural disasters;

  • fire;

  • flood;

  • earthquake;

  • epidemic or pandemic restrictions;

  • war or civil disturbance;

  • governmental restrictions;

  • transportation disruptions;

  • serious infrastructure failure; or

  • other legally recognized events of force majeure.

Where a force majeure event prevents the accommodation service from being provided, the parties shall act in accordance with applicable law and, where appropriate, seek a reasonable alternative such as rescheduling, credit or refund.


12. PROVIDER'S RESPONSIBILITIES

The Provider shall make reasonable efforts to provide the accommodation and services confirmed in the reservation.

If the reserved room becomes unavailable for reasons attributable to the Provider, the Provider shall seek to provide an appropriate alternative or otherwise resolve the matter in accordance with applicable consumer law.

The Provider shall not be responsible for Guest belongings except to the extent liability is imposed by mandatory law.


13. GUEST'S RESPONSIBILITIES

The Guest is responsible for:

  • providing correct reservation and contact information;

  • reviewing the reservation details before confirming the booking;

  • complying with payment and cancellation conditions;

  • presenting valid identification where required;

  • respecting hotel rules and applicable laws; and

  • informing the Provider promptly of any issue concerning the accommodation service.

The person completing the reservation represents that they are authorized to make the booking on behalf of all guests included in the reservation.


14. PERSONAL DATA

Personal data collected during the reservation and accommodation process shall be processed in accordance with applicable Turkish data protection legislation, including Law No. 6698 on the Protection of Personal Data (“KVKK”).

Information regarding the collection, processing, storage and protection of personal data is provided separately in the Provider's Privacy Policy and/or KVKK Information Notice.

Payment information may be processed directly by authorized banks, payment service providers or reservation platforms in accordance with their applicable security and privacy procedures.


15. COMMUNICATION AND NOTIFICATIONS

The Guest agrees that reservation confirmations, invoices, cancellation notices and other information concerning the booking may be delivered electronically using the email address, telephone number or other communication information supplied during the reservation.

The Guest is responsible for ensuring that their contact details are accurate and accessible.


16. COMPLAINTS AND CONSUMER DISPUTES

Guests are encouraged to contact Cappadocia Divin House directly regarding any complaint or service issue so that an appropriate solution can be sought.

For consumer disputes falling within the applicable monetary limits, the Guest may apply to the competent Consumer Arbitration Committee.

For disputes exceeding those limits or otherwise falling within their jurisdiction, applications may be made to the competent Consumer Court, subject to applicable procedural rules.

The Guest retains all mandatory rights granted under Turkish consumer legislation.


17. APPLICABLE LAW

This Agreement is governed by the laws of the Republic of Türkiye.

Nothing in this Agreement shall exclude or restrict any mandatory consumer right provided under applicable law.


18. ELECTRONIC RECORDS

The Guest acknowledges that this Agreement, reservation confirmation, payment records and related electronic communications may be stored electronically and may constitute evidence of the transaction to the extent permitted by applicable law.


19. ACCEPTANCE

By completing and confirming the reservation, the Guest acknowledges that they have:

  • reviewed the essential characteristics of the accommodation service;

  • been informed of the total reservation price and payment conditions;

  • reviewed the applicable cancellation and refund policy;

  • been informed that reservations for accommodation on specific dates are generally excluded from the statutory fourteen-day right of withdrawal;

  • reviewed the Provider's privacy and personal data information; and

  • accepted the terms of this Distance Sales Agreement.
